Terms of Use

1. Service provider and eligibility

The Service is provided by 14b s. r. o., company identification number (IČO) 47 612 801, registered office at Na Briežkoch 14506/20, 831 02 Bratislava–Nové Mesto, Slovakia.

You must be at least 16 years old and legally capable of entering into these Terms. If the law where you live requires you to be older, or requires a parent or guardian's consent, that rule applies. If you use the Service for an organization, you confirm that you have authority to bind that organization, and "you" includes it.

2. The Service

Fax Studio allows you to prepare, scan, import, edit, sign, send, receive, view, store, export, and delete fax documents, and to request an available personal fax number in supported locations. Features, destinations, number inventory, page or file limits, and availability may vary by country, provider capacity, device, app version, and operational limits.

The App may show a submission acknowledgement, queued or sending status, delivered status, failure status, page counts, or a receipt based on information available from our fax provider. A submission acknowledgement does not mean that a fax was delivered. A delivered status means the provider reported successful fax transmission; it does not prove that a particular person saw, read, or accepted the document.

The Service is not a telephone service, emergency service, certified-mail service, electronic-signature certification service, or guaranteed method for meeting a legal or contractual deadline. Keep your own copies and use an appropriate alternative channel when delivery is time-critical or legally significant.

3. Free launch and future offers

At launch, sending, receiving, and an eligible personal fax number are offered without a subscription or per-fax charge during an initial three-month promotional period. Exact campaign dates and any post-period offering will be displayed in the App or on iphonefax.app when finalized.

We may apply reasonable technical, security, page, file-size, destination, number-inventory, rate, and fair-use limits even while the Service is free. Free access has no cash value, cannot be transferred or resold, and does not guarantee unlimited usage or permanent retention of an assigned number.

We will not begin charging you merely because you used the free Service. Any future paid plan or purchase will require separate, clear terms and your express authorization through the applicable purchase flow. Changes do not create retroactive charges.

4. Accounts, security, and fax numbers

The App currently creates an internal anonymous account and stores its session on your device; it does not offer a customer login or cross-device account-recovery flow. You are responsible for your device, its passcode, and activity performed through your account. Notify support@iphonefax.app promptly if you suspect unauthorized access.

A fax number assigned through the Service is licensed for your use while the assignment remains active; it is not sold to you and you do not own it. Availability is not guaranteed. We may change, suspend, reclaim, or reassign a number when reasonably necessary for legal, provider, security, abuse-prevention, or service reasons. Account deletion releases your assigned number, which cannot be recovered and may later be assigned to someone else. After release, you must not represent that the number remains yours.

Do not publish or rely on an assigned number as permanent without maintaining a backup contact method. You are responsible for obtaining any consent needed before giving another person your fax number or sending data about them through the Service.

5. Your responsibilities

You are responsible for:

• checking the destination number, country, attachments, page order, cover page, and content before sending;
• having all rights, permissions, notices, and lawful bases needed to transmit the document and any personal data it contains;
• complying with telecommunications, privacy, confidentiality, records, professional, marketing, and fax-advertising laws that apply to you and the recipient;
• keeping your own records and confirming delivery through another channel when appropriate;
• protecting exported documents, notification previews, shared files, and access to your device; and
• paying any data, internet, mobile-carrier, or third-party charges not imposed by us.

6. Prohibited use

You must not use the Service to:

• send unsolicited advertisements, junk faxes, spam, fax blasts, mass messages, or communications that violate consent, opt-out, identification, or do-not-contact requirements;
• harass, threaten, defraud, impersonate, deceive, stalk, discriminate against, or harm another person;
• send unlawful, infringing, defamatory, obscene, exploitative, malicious, or privacy-invasive content;
• send content or personal data you do not have the right to use or disclose;
• interfere with networks or accounts, distribute malware, probe or bypass security, forge transmission data, or gain unauthorized access;
• avoid usage limits, create accounts or installations to evade controls, automate bulk activity, or resell or provide the Service to third parties without our written permission;
• reverse engineer, copy, modify, scrape, or extract source code or non-public data except to the limited extent such a restriction is prohibited by law; or
• use the Service in a sanctioned territory or in violation of export-control or sanctions laws applicable to you or us.

Fax advertising and solicitation rules vary by jurisdiction and may impose statutory damages. You-not 14b-are the sender and are responsible for determining whether a fax is lawful.

7. Your content and privacy

You retain ownership of content you provide. You grant us and our service providers a limited, worldwide, non-exclusive license to host, copy, convert, transmit, route, store, display to you, and otherwise process that content only as needed to operate, secure, support, and improve the Service, comply with law, and follow your instructions. This license ends when the content is deleted from our systems, subject to pending transmissions, legal requirements, security records, provider retention, backups, and copies held by recipients.

You confirm that your content and our permitted processing of it do not violate law, these Terms, or another person's rights. We do not claim ownership of your fax documents. We may preserve or disclose content when required by valid legal process or reasonably necessary to prevent serious harm, fraud, abuse, or a security incident.

Our handling of personal data is described in the Privacy Policy.

8. Sensitive information and healthcare use

You may choose to send documents containing sensitive information, but you do so under your control and responsibility. Use the minimum information necessary and verify the recipient carefully.

Fax Studio is not offered as a HIPAA-compliant service, and 14b does not currently enter into Business Associate Agreements for Fax Studio. You must not use the Service to create, receive, maintain, or transmit protected health information if a Business Associate Agreement or another healthcare-specific compliance arrangement is required.

9. App license and intellectual property

The App is licensed, not sold. Your license to the iOS or iPadOS App is governed by Apple's Standard End User License Agreement, unless a valid custom license is presented through the App Store. These Terms separately govern the fax and related services we provide.

We and our licensors own the Service, including its software, interface, branding, graphics, documentation, and other materials, excluding your content. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose. No other rights are granted.

Feedback you voluntarily provide may be used without restriction or compensation, provided we do not publicly identify you without permission.

10. Third-party services

The Service depends on Apple, internet access, telecommunications networks, Supabase, Telnyx, Google Firebase, Smartlook, and other providers. Their services and terms may affect availability and processing. You must comply with applicable third-party terms, including your mobile carrier's and Apple's terms.

We are responsible for the Service we provide, but we do not control a destination fax machine, the recipient, public telecommunications networks, or third-party services. Links to third-party websites are provided for convenience and do not constitute an endorsement.

11. Availability, delivery, and changes

We aim to provide a reliable Service, but fax transmission can fail or be delayed because of busy signals, invalid numbers, incompatible equipment, network conditions, provider outages, document issues, security review, recipient configuration, or events outside our control. Status information can also be delayed, duplicated, or corrected as provider events are reconciled.

We may maintain, update, limit, or discontinue features, destinations, or the Service. Where a change materially and adversely affects users, we will provide reasonable notice when practicable and required by law. Security, abuse, legal, and urgent operational changes may take effect immediately.

12. Suspension, termination, export, and deletion

You may stop using the Service at any time. The App provides an account export and an irreversible account-deletion flow under Info → Account data. Export anything you need before deletion.

We may limit, suspend, or terminate access if we reasonably believe you violated these Terms or law; created security, provider, cost, or abuse risk; or if continued service is no longer reasonably available. Where appropriate, we will give notice and an opportunity to address the issue, but we may act immediately to protect users, providers, or the Service.

Account deletion waits for active or uncertain fax and number operations to resolve, then releases your personal number and removes account data as described in the Privacy Policy. Deletion cannot recall transmitted faxes, remove recipient or exported copies, or guarantee immediate removal from provider backups and legally retained records. Account recovery is not available.

Sections that by their nature should survive-including content responsibility, intellectual property, disclaimers, liability limits, disputes, and accrued rights-continue after termination.

13. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available." We do not promise uninterrupted or error-free operation; permanent availability of any fax number; acceptance, legal effect, confidentiality, readability, or delivery of any fax; or compatibility with every destination, file, device, or network.

We disclaim implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing, to the extent the law permits. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

14. Limitation of liability

Nothing in these Terms limits liability that cannot legally be limited, including liability for intentional misconduct, gross negligence where applicable, fraud, or death or personal injury caused by negligence.

To the fullest extent permitted by law, 14b and its directors, employees, and contractors will not be liable for indirect, incidental, special, punitive, or consequential loss; lost profits, revenue, business, opportunity, goodwill, or data; missed deadlines; or losses caused by an incorrect recipient number, recipient conduct, unavailable number, failed or delayed fax, or third-party network or service.

To the fullest extent permitted by law, our aggregate liability arising from the Service during any twelve-month period will not exceed the greater of (a) the amount you paid us for the Service during that period or (b) EUR 100. This cap does not reduce any minimum remedy required by applicable consumer law.

If your unlawful content or misuse of the Service causes a third-party claim against us, you will reimburse reasonable losses and costs to the extent allowed by law and attributable to your breach. This does not apply to the extent the claim was caused by us.

15. Governing law and disputes

These Terms are governed by the laws of Slovakia, without regard to conflict-of-law rules. If you are a consumer, you also retain the mandatory protections of the country where you habitually reside and may bring a claim in any court available to you under mandatory consumer law.

Before filing a claim, please contact support@iphonefax.app so we can try to resolve the matter. If a dispute cannot be resolved, the courts of Slovakia have jurisdiction, except where mandatory law gives you the right to use another court or dispute-resolution process.

16. General terms and contact

We may update these Terms for legal, security, operational, or product reasons. We will post the updated Terms and change the date above. Material changes apply prospectively, and we will provide additional notice when required. If you do not agree to an update, stop using the Service and delete your account before it takes effect.

If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remainder will stay in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent. We may transfer them as part of a merger, reorganization, financing, or sale of the Service, subject to applicable law. These Terms and the Privacy Policy are the entire agreement concerning the Service, except for terms presented for a specific feature or purchase.
